Many physicians are working in a volatile liability environment; they face spiraling costs for malpractice insurance, have difficulties purchasing liability coverage at any price, and see record payouts in a growing number of claims against their colleagues. For contemporary political philosophy, this debate manifests in notions of ideal theory versus nonideal theory. Nonideal thinkers shift their focus from theorizing about full social justice, asking instead which feasible institutional and political changes would make a society more just. Ideal thinkers, on the other hand, question (...) whether full justice is a standard that any society is likely ever to satisfy. And, if social justice is unrealistic, are attempts to understand it without value or importance, and merely utopian? Consciousness is at once acutely familiar-it makes up the experienced moments of your waking (and perhaps your dreaming) (...) life. But consciousness also raises deep and interesting philosophical questions, questions about how any mere physical subject could produce such a wonder, and questions about how there could be a seemingly private and isolated spot of personal subjectivity in an objective, impersonal world. Perhaps the challenge of developing a satisfying theoretical understanding of consciousness is beyond us-we've reached the limits of what we can comprehend. Or maybe today's shortcomings are only temporary barriers to an illuminating theory of consciousness, one properly embedding it in our scientific worldview. In the past two to three decades health behavior scientists have increasingly emphasized affect-related concepts (including, but not limited to emotion) in their attempts to understand and facilitate change in important health behaviors, such as smoking, eating, physical activity, substance abuse, and sex. This article provides a narrative review of this burgeoning literature, including relevant theory and research on affective response (e.g., hedonic response to eating and drug use), incidental affect (e.g., work-related stress as a determinant of alcohol use), affect (...) processing (e.g., anticipated regret for illicit sex or skipping an exercise session), and affectively charged motivation (e.g., cigarette craving). Hayden White’s proposal that the meaning of historical writing is determined by the figure of speech (“trope”) which the historian applies to the data of research challenges a naive understanding of historical writing concerned merely with the presentation of past facts. To answer the charge that the poetic imposition of meaning does not allow for truthful representation of the Holocaust, White appeals to the knowable facts of the past which are then structured according to a figure of speech. He thus (...) hopes to secure the element of ideology critique while maintaining that facts are arranged according ta the historian’s decision and not according to the historian’s understanding of what was, in Lonergan’s language, “going forward” in the past. This essay argues that, although meaning is not already present in the events of the past, neither is it simply imposed on these events by the historian’s trope. Lonergan’s more adequate construal of historical writing recognizes the dynamism of inquiry which rejects a naive view of facts, yet also argues for the possibility of truthful, albeit always partial, representations of events. This essay emerges from a series of reflections on the presence of 'ethical' narratives and images of the Holocaust in debates and demonstrations around the recent conflict in Gaza. I argue that the lack of measure and violence of these narratives, which are now turned onto the descendants of the Holocaust, arise as a consequence of contemporary theories of the Holocaust that eschew the possibility of legal reflection, legal judgement and legal justice. I conclude with a discussion of Hannah Arendt's (...) attempts to rethink law in the wake of the Holocaust, a law that does not exceed its limited, but clearly defined, area of competence. (shrink)

Consciousness and Mind presents David Rosenthal's influential work on the nature of consciousness. Central to that work is Rosenthal's higher-order-thought theory of consciousness, according to which a sensation, thought, or other mental state is conscious if one has a higher-order thought that one is in that state. The first four essays develop various aspects of that theory. The next three essays present Rosenthal's homomorphism theory of mental qualities and qualitative consciousness, and show how that theory fits with and helps (...) sustain the HOT theory. A crucial feature of homomorphism theory is that it individuates and taxonomizes mental qualities independently of the way we're conscious of them, and indeed independently of our being conscious of them at all. So the theory accommodates the qualitative character not only of conscious sensations and perceptions, but also of those which fall outside our stream of consciousness. Rosenthal argues that, because this account of mental qualities makes no appeal to consciousness, it enables us to dispel such traditional quandaries as the alleged conceivability of undetectable quality inversion, and to disarm various apparent obstacles to explaining qualitative consciousness and understanding its nature. Six further essays build on the HOT theory to explain various important features of consciousness, among them the complex connections that hold in humans between consciousness and speech, the self-interpretative aspect of consciousness, and the compelling sense we have that consciousness is unified. Two of the essays, one an extended treatment of homomorphism theory, appear here for the first time. In a response to John Rawls’s 1993 article entitled, “The Law of Peoples,” Karl-Otto Apel argues that the concept of “overlapping consensus” is not sufficient for a basis or foundation for global justice. Apel makes the claim that when Rawls transfers the problem of justification from a general moral conception of justice to overlapping consensus the “weight of justification” is transferred to a “freestanding” conception of justice. To the extent that it does this, Rawls’s theory fails to show why a (...) freestanding conception of justice ought to be acceptable. In order to do so, Apel believes that, since citizens’ reason must be addressed, the weight of justification for a freestanding view must be based on a philosophical consensus theory. This would not mean that the need of a factual consensus would be dispensed with. Rather, it would mean that a freestanding view would be grounded philosophically “by a conception of an ideal consensus that serves as a regulative principle for searching and also for questioning an overlapping consensus.”. Epicureanism in The First Circle stands for the ethics of Stalinist society and furnished Solzhenitsyn with the vehicle for a destructive critique of Stalinist moral theory. But Stalinism has tended to be viewed in the West chiefly as a vicious form of political opportunism, its implicit ethical structure has escaped due recognition. But Stalinism was more than one man's strategy for the seizure and consolidation of power, more even (...) than the collective aims, policies, and methods of the Soviet bureaucracy. The ideological component of Stalinism must not be neglected. Howsoever the integrity of its doctrines was subordinated to political exigencies of the moment, Stalinist ideology could lay claim to a coherent and distinguished intellectual ancestry: it was heir to the materialist philosophy of the so-called Left Hegelians , a philosophy militantly reinterpreted by the architects of the Russian Revolution. Stalinist ideology expected a profound influence on the popular notions of obligation and moral value during the period of its ascendancy, smoothing the way of acquiescence and cooperation for the reluctant, the dubious, and the conscience-stricken. One need not therefore subscribe to an idealist interpretation of history in order to agree with Solzhenitsyn that Stalin's creation of an univers concentrationnaire would have been impossible without an accessory code of official ethics. The reward infrastructure in science centres on publication, in which journal editors play a key role. Reward distribution hinges on value assessments performed by editors, who draw from plural value systems to judge manuscripts. This conceptual paper examines the numerous biases and other factors that affect editorial decisions. Hybrid and often conflicting value systems contribute to an infrastructure in which editors manage reward through editorial review, commissioned commentaries and reviews and weighing of peer review judgments. Taken together, these systems and (...) processes push the editor into a role resembling censorship. Editors and authors both experience this phenomenon as an unintended side-effect of the reward infrastructure in science. To work towards a more constructive editor-author relationship, we propose a conversation, an exchange between editor and author in which value is collectively assessed as obligatory passage points in the publishing process are traversed. This paper contributes to the discourse on editorial practices by problematising editorial paradigms in a new way and suggesting solutions to entrenched problems. (shrink)

Faces carry key personal information about individuals, including cues to their identity, social traits, and emotional state. Much research to date has employed static images of faces taken under tightly controlled conditions yet faces in the real world are dynamic and experienced under ambient conditions. A common approach to studying key dimensions of facial variation is the use of facial caricatures. However, such techniques have again typically relied on static images, and the few examples of dynamic caricatures have relied on (...) animating graphical head models. Here, we present a principal component analysis -based active appearance model for capturing patterns of spatiotemporal variation in videos of natural dynamic facial behaviours. We demonstrate how this technique can be applied to generate dynamic anti-caricatures of biological motion patterns in facial behaviours. This technique could be extended to caricaturing other facial dimensions, or to more general analyses of spatiotemporal variations in dynamic faces. (shrink)
